Bersatu Youth members lodge police report against Azalina, MACC for leaking Justice Mohd Nazlan's probe letter
KUALA LUMPUR, April 12 — Parti Pribumi Bersatu Malaysia (Bersatu) Youth wing members lodged a police report today accusing de facto law minister Datuk Seri Azalina Othman Said and the Malaysian Anti-Corruption Commission (MACC) of leaking a High Court judge’s investigation letter.
In a police report sighted by Malay Mail, Armada assistant secretary Muhammad Faiz Rahmat said that Azalina and the national anti-graft agency had no right to investigate whether a judge had breached the Judge’s Code of Ethics 2009.
Citing a leaked letter, he also said that Azalina had allegedly affirmed that Justice Datuk Mohd Nazlan Mohd Ghazali had breached the judicial code of ethics in the latter’s judgment against the disgraced former prime minister Datuk Seri Najib Razak’s SRC International corruption case.
“So it is clear that MACC has leaked their secret information to Azalina to be further leaked to the mass media and blogs to give a false impression that Mohd Nazlan has made an unfair decision in convicting Najib Razak in the SRC criminal trial.
“This is a conspiracy to smear Mohd Nazlan as a dishonest judge and erode the credibility of his judgment against Najib. The implication is to destroy public confidence in the Malaysian judiciary,” he said in a police report lodged at Dang Wangi station.
Muhammad Faiz also said that the latest turn of events on Azalina’s leaked letter to Najib’s lead counsel Tan Sri Muhammad Shafee Abdullah was a conspiracy committed with ill intention to jeopardise the reputation of the country’s judiciary status.
He said that both Azalina and MACC needed to be investigated as the investigation against Mohd Nazlan was unlawful as it was not done without following the protocol.
“The facts above clearly show MACC’s modus operandi in leaking and/or making announcements to give people the impression that the target of their investigation is guilty before they investigate or file any charges in Court for collateral purposes,” he added.
Previously, Azalina said that only the judiciary has the authority to evaluate alleged breaches of ethics involving Mohd Nazlan.
On February 24, the Federal Court unanimously held that the MACC’s investigation against Mohd Nazlan did not follow proper protocol.
The seven-judge panel was led by Chief Justice Tengku Maimun Tuan Mat in presiding over a suit filed by three lawyers that challenged the MACC’s investigation on Mohd Nazlan over claims that the latter had an unexplained RM1 million in his account.
Mohd Nazlan was the trial judge in the High Court who convicted former prime minister Datuk Seri Najib Razak of embezzling RM42 million belonging to SRC International Sdn Bhd, a former unit of sovereign investment firm 1MDB.
Mohd Nazlan has since been elevated to the Court of Appeal.
