Michael Madsen Files for Divorce from His Wife of 28 Years, Alleges She Drove Their Son to Die by Suicide

In court documents seen by PEOPLE, the 'Kill Bill' star claims the couple separated shortly after their son Hudson died in January 2022

Michael Madsen has filed for divorce from his estranged wife DeAnna Madsen after 28 years of marriage.

Per court documents obtained by PEOPLE, the Kill Bill actor, 66, cited irreconcilable differences as the reason for the split, claiming they'd separated shortly after their 26-year-old son Hudson's death by suicide on Jan. 25, 2022.

The documents dated Tuesday, Sept. 17 were filed in a Los Angeles court and stated that the couple had tied the knot on April 15, 1996.

In a statement signed by Madsen and attached to the petition as part of the legal filing, the star accused his estranged wife of driving their son to die by suicide "by her neglect, drinking and alcoholism," insisting the "irreconcilable differences" he'd listed did "not adequately describe the divorce filing."

Madsen, who is being represented by his longtime lawyer Perry Wander in the filing, has requested a domestic violence restraining order, per the documents, as well as denying the domestic violence charges against him by DeAnna last month.

"Respondent also significantly contributed to my personal issues as well. I am a victim in an abusive, co-dependent, and toxic relationship that culminated in the Respondent breaking into my residence and having me wrongfully arrested for DV," Madsen's statement further alleged.

Madsen's representatives didn't immediately respond when contacted by PEOPLE for comment.

The divorce filing comes after PEOPLE reported that Madsen had been taken into custody in the early hours of Saturday, Aug. 17, after being arrested under California Penal Code section 243(e)(1), which is battery of a spouse, per online records. His bail was set at $20,000. On Monday, Aug. 19, PEOPLE then confirmed that a rep had stated that the actor had returned home.

Later that week, the star's attorney Wander told The Hollywood Reporter that Madsen "confronted" his estranged wife and "asked her to leave" the house, adding at the time that it "has been an ongoing problem."

“Michael has shown immense compassion and restraint during this period towards his estranged wife,” Wander continued. “He’s definitely not guilty of domestic violence.”

DeAnna responded, "Michael is struggling with his own personal issues. Myself and our children have been supporting him to the best of our ability. We would request privacy at this time," per THR.

Madsen previously addressed their son Hudson's death in a statement shared with The Los Angeles Times in January.

“I am in shock as my son, whom I just spoke with a few days ago, said he was happy — my last text from him was ‘I love you dad,’” the actor said in a statement to the outlet.

“I didn’t see any signs of depression. It’s so tragic and sad. I’m just trying to make sense of everything and understand what happened,” he added at the time.

"He had typical life challenges that people have with finances, but he wanted a family. He was looking towards his future, so it's mind blowing. I just can't grasp what happened," Madsen continued.

Hudson lived in Hawaii with his wife Carlie, according to their social media. They're thought to have moved to the island of Oahu in 2019.

Madsen and DeAnna also share sons Calvin, 27, and Luke, 18, while the actor is father to sons Christian, 34, and Max, 30, from a previous relationship with Jeannine Bisignano.
