EC confirms no by-election for vacant Batang Kali state seat in Selangor

KUALA LUMPUR, Feb 22 — The Election Commission (EC) today announced that there will be no by-election for the vacant Batang Kali state seat in Selangor.

EC secretary Datuk Indera Ikmalrudin Ishak said that the commission had received formal notification from Selangor State Assembly Speaker Ng Suee Lim yesterday about the vacancy in Batang Kali.

“The state seat was declared vacant under the Article LXIX of the Constitution of the Selangor Government 1959,” he said in a statement.

Indera said that Ng had advised EC that there is no need to fill the contingency vacancy based on the second part of the Selangor Government Constitution 1959, Chapter 5 Article LXX (5).

“Therefore, no-by-election will be held for the Batang Kali state seat in Selangor,” Indera said.

Last week, Ng declared that the Batang Kali state seat has been vacant after its assemblyman failed to attend the state assembly sitting for more than six months.

Ng said Harumaini Omar of Pejuang ,who is the Batang Kali assemblyman, did not provide any reason for his absence.

Ng said Harumaini was last present at the state assembly on July 27, 2022 and the six-month period was calculated from the next day.

In the 14th general election, Harumaini won the state seat with a 8,315 majority. He previously contested under the Pakatan Harapan banner and he was with Bersatu then.
