FORMER DBKL CLERK LOSES APPEAL AGAINST CHEATING

KUALA LUMPUR, Oct 30 (Bernama) -- The High Court here today dismissed the appeal of a former Kuala Lumpur City Hall (DBKL) clerk against her conviction and sentence for cheating.

Justice Datuk Ghazali Cha held that the Sessions Court did not err in convicting Rosyatimah Kamarudin and sentencing her to 12 months jail and RM3,000 fine in default six months jail.

Rosyatimah, 43, was found guilty of cheating businessman Zainal Abidin Gimin, 44, by deceiving him into believing that she could speed up the payment of a local order by DBKL and inducing him to hand over RM3,000 to her.

The offence was committed at Hanifah Restaurant, Medan Tuanku, Jalan Raja Laut, here on May 8, 2003.

Ghazali allowed an application by Rosyatimah's counsel, Dir Kheizwan Kamaruddin, for a stay of execution of the sentence pending appeal to the Court of Appeal and doubled the bail to RM10,000 with one surety.

Counsel has to file the notice of appeal by Monday.
